Planning commission recommends approval of Vertex Waste amendment to allow three wells to meet landfill water demand

The Imperial County Planning Commission voted to recommend approval of an amendment to Conditional Use Permit 24-0018 for Vertex Waste Industries to authorize use of three wells to meet daily water demands for landfill mitigation.
Planning staff said the proposal — at 935 West Highway 86 — would authorize three wells so the facility can meet a stated requirement of 92,000 gallons per day for about 165 days per year to satisfy mitigation measures referenced in an earlier environmental review for the landfill expansion. Luther Carano, the planner presenting the item, said the original well and replacement well alone cannot produce the required 92,000 gallons per day and that the additional well would allow the applicant to meet daily water demands.
Staff recommended adoption of a mitigated negative declaration, finding the proposed amendment would not have a significant effect on the environment as recommended by the Environmental Evaluation Committee on March 13, 2025. Dave Brishke, representing BurTech for the applicant, told the commission he had read the project materials and agreed with the staff recommendations.
No members of the public raised objections during the hearing; the commission’s roll-call vote to recommend approval was recorded as unanimous “yes.” The motion recorded in the transcript was: “Recommend approval of conditional use permit 24Dash0018 as recommended by staff.”
If approved by the Board of Supervisors, the CUP will be subject to the conditions in the staff recommendation and the mitigated negative declaration adopted by the commission.
