The Planning & Zoning Board approved an amendment to the Windward Shipyards conservation-overlay mitigation plan that adds five 18-inch DBH southern live oaks to the town-center mitigation area, and then recommended approval of a linked PUD modification (rezoning/amendment) to the city commission.
Applicant representatives said the added trees fulfill the original intent to transplant or install large specimen trees in the town center after earlier removals. The board voted to approve PZB202538 (mitigation amendment) after applicants and staff confirmed the proposal includes five 18-inch-diameter-at-breast-height (DBH) live oaks to be planted or guaranteed in the town center; the agreement includes replacement or a payment of $40,000 per specimen if a tree dies for reasons other than an act of God, with the city retaining the option to replace on city-owned preserved land or require on-site replacement.
During the PUD discussion the board recommended approval to the city commission for the PUD modification; commissioners will consider the rezoning/revision at a future meeting. Board members pressed developers on a separate issue: cedar trees that had been relocated earlier as part of the project and now appear stressed or dead. Developers and Toll Brothers (the townhome parcel owner) confirmed they are working with staff on how to replace or credit any cedars that were lost; the board asked that the replacement approach be documented and enforced as part of the PUD/development order rather than left to informal follow-up.
