Live Oak council awards $391,805.64 contract for final phase of 2022 street bond

The Live Oak City Council voted 5-0 Tuesday to award the Phase 4 contract for the city’s 2022 bond-funded streets, bridges and sidewalks program to Clark Construction of Texas Inc. for $391,805.64.

Mark Waxer, city staff, told council the city received three bids through the formal bidding process and that Clark Construction submitted the low combined bid. "The low bid amount was $391,805.64 from Clark Construction of Texas," Waxer said. He said Phase 4 is the final phase of the bond project.

The vote came after a brief public and council discussion of schedule and contingency funding. Council members asked whether Phase 3 and Phase 4 would be worked on at the same time; Waxer confirmed they would. He said Phase 4 will have a shorter construction window, with staff setting a roughly 60-day completion target to meet the city's July deadline; Phase 3 had previously been scheduled for a longer duration that staff described as about 180 days.

Council members also asked about contingency amounts. A council member asked whether to add a 10% contingency; Waxer said the city would identify the specific streets for Phase 4 and bring back a change order request and that the contingency is likely to be "more like 25%" and would be presented to council for approval.

Mayor Pro Tem Tollgren moved to approve the resolution awarding the Phase 4 contract to Clark Construction of Texas Inc. in the amount of $391,805.64; Councilman Perez seconded. The clerk recorded the motion as passing 5-0. The resolution authorizes the city manager to take any additional actions reasonably necessary, includes a severability clause, and establishes an effective date.

The contract award closes out the advertised Phase 4 procurement; staff said they will return with the recommended change order and contingency allocation before finalizing construction tasks that exceed the base bid. The council's action does not itself change the scope of prior phases or appropriate additional bond funds; any request for additional funding or change orders will be brought back to the council for formal approval.

Council and staff thanked the bidders and project team for the procurement and noted the award completes the advertised phases of the 2022 bond street program. The council did not set a separate effective date in the meeting beyond the resolution language authorizing the city manager to take necessary steps to implement the award.
