Park City City Council on Oct. 14 adopted a resolution finding the structure at 5755 North Broadway “dangerous and unsafe” and directed the owner to repair or remove the building within 90 days, citing state statute KSA 12-1753.
The public hearing included a presentation by Building Official Gabe Ponce, who showed council photographs and described deteriorated roof coverings, holes, leaning exterior walls and other code violations. “As you guys can see by the pictures there, it’s in pretty rough shape,” Ponce said, adding he would not consider the structure safe to occupy.
City attorney staff advised the council to adopt the resolution so the city would retain the statutory authority to act if the owner did not complete demolition. The resolution directs the owner and any other interested parties to commence repair or removal no later than 90 days from the resolution date; if the owner fails to act, the city may proceed and assess costs as a lien on the property.
Owner and contractor status: Ponce told council the owner had submitted a demolition permit application on Nov. 25 (year not separately specified in the hearing), stated that she intends to demolish the building herself and is using Supreme Construction LLC as the contractor for the demolition. Ponce also explained the owner was waiting on Kansas Gas to disconnect the gas service before demolition could proceed.
