City legal staff told commissioners that a law partner’s prior work for the employee created an ethical conflict that would make representing the city on the matter problematic without waivers. Commissioners approved retaining Arnold Stultz at the same hourly rate proposed by the city attorney and discussed how to coordinate the negotiations. The commission agreed that any meeting with outside counsel and the commission must be a public meeting; some commissioners suggested holding a special-called public meeting to focus on the negotiations to avoid repeated back-and-forth work and additional fees.
Commissioners asked who should be the point of contact for the outside counsel; the mayor was proposed and accepted. Staff will facilitate initial contact between the mayor and Arnold Stultz.
