On June 11 the City of Anna Charter Review Commission approved redline revisions to Charter Article 10, which covers utility and public-service franchises and licenses. The commission voted to forward the redline to the city council as part of the commission’s final report.
Commission discussion focused on the scope and duration of franchises, how costs for expanding infrastructure are allocated, and water-quality oversight. Clark, the commission’s staff legal adviser, said franchise agreements often include a time limit (commonly 20 years) to prompt periodic renegotiation. Clark also explained that it varies whether developers, utilities or the city bear the costs of infrastructure expansion; the franchise agreement and city code normally spell out specific obligations.
Commissioners asked about water-quality standards and enforcement. Clark said the city and franchise utilities must meet minimum standards set by the Texas Commission on Environmental Quality (TCEQ), including required testing and reporting; TCEQ investigates complaints when standards are not met. Commissioners discussed ensuring the council has contractual and enforcement tools to hold franchise utilities accountable if service standards are not met.
A motion to approve Article 10 as redlined was made, seconded and passed unanimously. The redline will be included in the final report to council for review.
