Spokane Valley council moves right-of-way permitting out of development code, adopts updated permitting chapter

The Spokane Valley City Council unanimously approved two related ordinances to reorganize and update the city's right-of-way permitting framework.
Council approved Ordinance 25-007 (CTA 2024-002), which removes right-of-way permit procedures from the development regulations in chapters 17.8 and 22.13, and moved Ordinance 25-008 to adopt a dedicated right-of-way permitting chapter and amend chapter 7.05 to update permit procedures and enforcement. Senior Deputy City Attorney Tony Beattie described the pair as “fairly simple,” saying the first ordinance removes the permit requirements from development regulations and the second adopts the right-of-way permit process into Title 9.
The second ordinance updates insurance requirements, links code provisions to the master fee schedule, clarifies exemptions and sets enforcement procedures related to right-of-way permits, staff said. Councilmember Merkel noted the changes do not alter substance from the prior presentation; city staff confirmed the package is primarily clarifying language to improve right-of-way management. There was no public hearing for the first ordinance; the second had public comment but no objections were recorded.
Both motions were moved, seconded and passed unanimously.
