Elkhart County commissioners deny noise-variance request for quinceañera after prior complaints

The Elkhart County Board of Commissioners on May 27 unanimously denied a noise-variance request from Yesenia Cisneros, who asked to hold a quinceañera at her home on July 26 from 5 p.m. to 11 p.m.

Cisneros, who identified herself as living at 29852 Cleveland Avenue, told the commissioners she had gathered neighbor support letters and was willing to comply with conditions. “If the commission sees fit to grant my permit, I'm more than willing to comply with any reasonable conditions you may suggest,” she said.

Commissioners said the denial followed a prior permitted event at the same address after which the sheriff’s office responded to complaints after 11 p.m. One commissioner told Cisneros, “you blew it,” saying the prior waiver had been violated and that the sheriff’s response used county resources. Commissioners emphasized that the applicant was not banned from hosting the party but must keep volume low and respond if deputies ask the music to be turned down.

The board voted to confirm the earlier denial by motion; the vote carried unanimously.

Why it matters: The decision illustrates how enforcement and prior enforcement contacts shape the county’s willingness to grant noise waivers. Commissioners cited neighborhood sleep rights and sheriff responses as reasons for denying a repeat variance.

The commissioners noted the county noise ordinance includes measurable decibel standards and suggested the applicant consider using a phone or a decibel meter to check levels; they did not set an alternative permitted end time, reiterating that compliance with the ordinance and avoiding sheriff responses would allow events to proceed without a waiver.

The board moved to the next agenda item after recording the unanimous denial.
