Commissioners said the property has repeatedly returned to noncompliance and that the commission previously voted to require the entire lot to be addressed. At the meeting a commissioner moved to proceed with remediation under the existing order and, if necessary, move the matter to city council for city-conducted cleanup. The commission recorded a motion to proceed and provided the owner ten days to appeal before the city would step in.
Why it matters: The commission said the property has been an ongoing source of neighborhood complaints and that persistent noncompliance may require city action and assessment of cleanup costs against the property.
City staff said the estimate for a contractor to clear the property was $3,000 but that final costs would depend on actual volume and dump fees. A lien related to prior administrative fees was confirmed in staff comments.
The motion to move the matter forward to city cleanup if not resolved was seconded and carried unanimously (Vice Chairperson Souder: yes; Commissioner Myers: yes; Commissioner Thompson: yes; Commissioner Vallone: yes; Chairperson Davis: yes). The owner was given 10 days to appeal the planned city action.
Next steps: If the owner does not file an appeal within the 10-day period, staff will obtain bids and the city may proceed with contracted cleanup and assess costs to the property. The commission directed staff to prepare the necessary documentation for potential city cleanup and lien placement.
