Maui County Council approves Crystal Thomas to Commission on Persons with Disabilities after other nominee withdraws

The Maui County Council on June 12 adopted Resolution 25-125 to appoint Crystal Thomas to the Maui County Commission on Persons with Disabilities, voting 6-0 with three members excused.
The action followed a procedural issue when one of the two nominees named in the resolution, Lisa Marie Tylerman, submitted a written withdrawal. Council legal staff advised that a timely written withdrawal should not be acted upon and that the withdrawn name should be omitted from both the approval and disapproval exhibits. Councilmember Lehi Hagen moved the resolution and Vice Chair Yukile Sugimura seconded the adoption as amended to place Crystal Thomas on the approval exhibit with a term expiring March 31, 2027.
David Rotz, director in the Office of Council Services, told the council: “Perhaps the nominee who is withdrawn would just not have her name moved to either the approval or disapproval exhibit. It would just not be acted upon as First Deputy Corporation Counsel had recommended.” First Deputy Corporation Counsel Mimi Desjardins had earlier advised the council about following the code when a written withdrawal is received.
Council members discussed the timing and procedural implications before withdrawing the portion of the motion that would have acted on Tylerman. After that change, members voted to move Crystal Thomas’s name to the approval exhibit. The motion carried 6 ayes, 0 nos; Councilmembers Tom Cook, Shane Senesi and Keani Rollins Fernandez were recorded as excused.
The resolution originally listed two appointments. The council recorded Crystal Thomas’s term on Exhibit B as expiring March 31, 2027; the withdrawn nominee, Lisa Marie Tylerman, was not acted on due to the written withdrawal and the council’s reliance on Maui County Code section 2.41.060 for procedure on withdrawn nominations.
The meeting record shows the matter was discharged from the Government Relations, Ethics and Transparency Committee for floor consideration before the council acted on the amended resolution. No public testimony was taken on this item during the meeting.
The council adjourned the special session after completing this and other agenda items.
