Rockwall planning commissioners allow reapplication after prior denial with prejudice

The Rockwall Planning and Zoning Commission voted to allow an applicant denied with prejudice to submit a new specific-use-permit application for a residential infill site, saying the commission would exercise discretion to permit a reapplication.

The vote comes after the applicant’s earlier request was denied with prejudice by the City Council after no representative appeared for that council hearing. Planning staff told the commission the applicant later submitted a new application and asked the commission to permit resubmittal under the Unified Development Code relief process that allows reconsideration when a change of condition or other circumstances exist.

Planning Director Ryan told commissioners the case is “somewhat of a unique situation” because staff did not identify a substantive change of condition from the previous request but presented the discretionary relief process to the commission. Tyler Pinkston, speaking for Jarrett Smith, said the missed council appearance was a scheduling misunderstanding. "He had informed me that the meetings all were on Tuesdays and had changed to a Monday, which was the cause for the scheduling confliction," Pinkston said.

Commissioner Hastings moved to approve the reapplication; the motion carried. Commissioners and staff reminded the applicant that future attendance is required at subsequent Planning and Zoning and City Council meetings. Staff also noted the applicant’s submittal deadline and that the applicant will have three meetings to attend after the packet is filed.

The commission recorded the motion as approved; the transcript shows the approval call as "approved, 5 2 0." The commission instructed the applicant to ensure a representative attends both future Planning and Zoning and City Council hearings.
