CPS Energy, with consultant Adams Environmental, enrolled the project under CPS Energy’s systemwide habitat conservation approach and does not seek incidental‑take authorization from the SEPHCP for this project. Staff said, under a memorandum of agreement dated March 20, 2024, CPS Energy will pay the SEPHCP $492.53 to account for impacts equivalent to 0.8955 units of karst mitigation within the SEPHCP permit area.
Staff told the committee the applicant had paid a $2,500 processing fee; if the committee approved the enrollment recognition, CPS Energy would need to pay the additional $492.53 to complete enrollment documentation. Staff recommended approval and said the payment is a contribution “towards the future establishment, management, monitoring, and funding” of SEPHCP karst preserves; staff also stated no incidental‑take authorization from SEPHCP is required for this project because CPS Energy’s systemwide HCP provides the necessary coverage.
A committee member summarized the distinction: CPS Energy has its own permit but is making the payment under the MOA rather than participating directly in the SEPHCP for incidental‑take authorization. Committee member Bob Brock moved to approve; Ken McGlamory seconded. The committee approved the staff recommendation by voice vote.
