The board took votes to (a) allow late filings under the county/state waiver standard for good cause, (b) schedule hearings for several commercial properties, (c) deny telephone testimony in complex commercial matters, and (d) authorize subpoenas for evidence in several pending hearings.
Waivers and individual residential case: The board granted a waiver of the 48-hour notice requirement and placed Chris Engstrom’s residential objection (3717 Blue Wing Place) on the hearing schedule after Engstrom said he had missed the open-book window while moving family and called the assessor as soon as he realized the deadline had passed. The board voted to allow the Engstrom case to be scheduled; the clerk said the hearing will likely be scheduled for the evening of June 17.
Ownership-change / commercial waivers: The board also granted a waiver for a set of objections connected to a recent ownership change at multiple parcels owned by 1 Parker Place LLP (later purchased by Arthur T. Donaldson Jr.). Counsel for the property owner explained that closing and transfer of partnership interests occurred in late April and that critical income-and-expense records and post-closing financials were not available before the 48-hour deadline. For the Holiday Inn Express matter (pending circuit court proceedings), the board moved to waive the Board of Review hearing into circuit court under historical practice for that case type; the board instructed staff to issue a written determination.
Subpoenas: The assessor requested subpoenas for several pending hearings so the board can obtain income-and-expense records and other supporting documents. The board approved subpoenas (or authorized the chair to sign them) for five matters including the Baymont/Baymont by Wyndham (Whitesell Living Trust / Baymont), Cambek Petroleum (ag use questions), Festival Foods (NS Retail), Hampton Inn (Grand Valley Hospitality) and the two large retail matters (Walmart and Sam’s). Several board members asked staff to avoid issuing subpoenas for cases already scheduled as dismissal hearings until the board rules on completeness.
