MDC ratifies multiple no-appeal zoning petitions and upholds denial for one rezoning appeal

The Metropolitan Development Commission on June 4 ratified a set of zoning petitions that had no appeals and upheld a hearing examiner recommendation to deny one rezoning request.
Staff read a docket of petitions of no appeal recommended for approval, including petitions at 82852 East County Line Road (Perry Township, ZON016), 2508 West Michigan Street (Wayne Township, ZON034), 445 Sanders Street (Center Township, ZON035), 550 North Washington Boulevard (Center Township), and 2310 Prospect Street (Center Township). The clerk also read amended CAP 804 at 324 West Morris Street and 325 Wilkins Street and R E G 027 at 40 South Alabama Street.
The commission took a single vote to ratify eight previously approved zoning petitions of no appeal. The clerk called the roll and announced the items were approved.
The commission then considered petition 2025 ZON025, an application to rezone property in a transit-oriented overlay for an automobile sales facility. Staff explained the property was recommended for community commercial (consistent with its existing C4 zoning) and is within a transit-oriented development (TOD) overlay; staff and the hearing examiner recommended denial because an automobile sales facility was determined to be incompatible with the comprehensive plan recommendation and the TOD overlay. The transcript records staff stating: "The request at hand was to rezone to C5 specifically for the operation of an automobile sales facility, which staff determined was incompatible with both the comprehensive plan recommendation as well as the overall goals and intent of the TOD overlay. Therefore, staff recommended a denial, which was also the recommendation of the hearing [examiner]."
The commission voted to uphold the hearing examiner's recommendation to deny the rezoning. The clerk announced the result in the transcript as: "passes and upholds the denial 8 2 0" (meeting record). The clerk also framed a yes vote as upholding the recommendation for denial and a no vote as overriding it.
Why it matters: Rezoning decisions determine permitted land uses and can affect traffic, transit compatibility and neighborhood plans. In this case, staff and the hearing examiner concluded an automobile sales operation was not compatible with the TOD overlay and the community commercial recommendation.
No public speakers addressed ZON025 during the hearing. The commission concluded its agenda after the vote.
