Council approves ordinance amending location language for several zoning chapters; planning commission recommendation noted

The Virgin Town Council on May 20 moved to adopt Ordinance 2025-O-08, amending language related to the stated location of certain zones in multiple land-use chapters and standardizing how the town references the time of adoption in the ordinance text.

Councilmembers reviewed the planning commission’s packet, which showed the planning commission had considered the amendments and recommended approval by a 3–2 vote. The council’s motion modified draft ordinance language to remove placeholder dates and to insert the phrase “at the time of adoption of this ordinance” where appropriate so that the ordinance text would not depend on a date printed in a draft.

During discussion members asked whether existing properties previously approved under highway-resort (HRZ) zoning would remain allowed if they were located outside newly described distance limits. Staff confirmed that parcels already zoned HRZ would be grandfathered and could continue to use existing permitted uses; new rezones or future parcels would be subject to the updated distance limitation. Staff also said parcel-splitting or partitioning approaches could be used where a parcel extended beyond the new distance limit to avoid creating split‑zone parcels without a proper application.

A motion to adopt the ordinance with the revised phrasing was made and seconded; the council voted in favor and moved to publish the amended ordinance with the finalized wording and dates at adoption.
