Fulshear ZBA approves variance to allow monument sign outside gas-pipeline easement at 27250 FM 1093

The City of Fulshear Zoning Board of Adjustment voted unanimously on May 29, 2025, to grant a variance allowing a monument sign for Flight Signs at 27250 FM 1093 to be sited outside the ordinance-mandated placement along the public right-of-way.
The board approved the variance after hearing from the applicant and city staff that a 20-foot gas pipeline easement runs along the property and makes it difficult to place a permanent sign within the code-required zone. The board said findings required under Texas Local Government Code section 2.11 were met and entered on the record.
City planning staff told the board that staff recommends approval because the city has granted similar variances for other businesses on that stretch of FM 1093 that are constrained by the same pipeline easement. John Shepherd, speaking for Flight Signs, said the pipeline easement would make obtaining an easement for a permanent sign difficult and that precedent exists for similar relief in the immediate area.
Board members discussed the need to put required legal findings on the record in case of appeal and asked that the motion reference Texas Local Government Code section 2.11. After withdrawing an earlier motion to tighten the findings language, the board adopted a motion that the findings under section 2.11 were fulfilled and approved the variance.
The chair noted that the pipeline runs along the north side of FM 1093 and observed that many future businesses on that corridor would likely need similar variances under the current code, which specifies a minimum and maximum of 10 feet for monument sign placement. The chair recommended the City Council consider revising that portion of the Coordinated Development Ordinance (CDO) to provide more flexibility.
