Commission moves ResacaFest booking agreement to executive session; later approves rescheduling agreement

Eloy Avila, who is overseeing parks and events, explained that the city and Empowerment Endeavors had negotiated a rescheduling arrangement for performers affected by the earlier cancellation. He said one artist’s visas were revoked and that the organizers had to replace that act; the remaining artists were rescheduled.
Commissioners raised concerns about terms common in the live-entertainment market: deposit schedules, rescheduling fees and risk allocation when performers cancel or cannot travel. One commissioner asked whether municipalities across the region could act together to refuse suppliers who impose unfavorable terms; staff noted the market for artists often works on the artists’ terms.
The rescheduling fee cited during discussion was approximately $40,000, described by presenters as a nominal rescheduling cost compared to market rates. Officials explained parts of event funding could come from a split between the Parks department and the Economic Development Corporation’s event budget; the city also has an outstanding insurance claim related to the earlier cancellation.
Because the contract raised contractual and legal questions, the commission sent the item to executive session for legal consultation. After executive session the commission returned and took public action: a motion to approve item 12 (booking agreement with Empowerment Endeavors LLC for ResacaFest 2025) was made by Commissioner Goodman, seconded by Commissioner Navarro, and the commission voted “Aye.” The motion passed.
Commissioners also directed staff to pursue stronger insurance and contracting practices for future large events and to present a summer-event plan including insurance options to reduce the city’s exposure.
