The Dallas Board of Adjustment voted unanimously on Tuesday to allow a resident at 9670 Linbrook Drive to construct and maintain an 8-foot-high fence along Walnut Hill Lane, granting a special exception to the fence-height rules in the Dallas Development Code.
Applicant Islin Litt and her representative, Nicholas McKissick, told the board she works from home, has been the target of repeated trespassing and property damage, and is seven months pregnant. The application sought an increase from the typical 6-foot limit to an 8-foot board-on-board fence in the location that faces a bus stop and high foot traffic.
McKissick said the proposed fence is board-on-board (non-see-through) construction and that previous incidents included people attempting to remove fence posts or peer into the property. The applicant submitted petitions and neighbor signatures indicating support from immediately surrounding houses, and staff confirmed receipt of petitions circulated by the applicant.
Board members focused their review on the code standard for special exceptions — whether the proposed fence would ‘‘adversely affect neighboring property.’’ Several members said the applicant’s outreach to neighbors and the fence location made it unlikely the structure would harm adjacent properties.
Kathleen Davis moved to grant the request; Rachel Hayden seconded. The motion passed 5–0. The board imposed a condition requiring compliance with the most recent submitted plans.
A decision letter will be mailed to the applicant by the board administrator.
