The applicant for the Oaks at Lakeway Planned Unit Development (PUD) amendment submitted a formal withdrawal of its proposal on Monday, and Lakeway City Council said the withdrawal did not erase a previously identified PUD ordinance violation.
Council described a sequence of events in which the city earlier found the property owner out of compliance with an existing PUD condition related to roadway construction. The council had ordered staff to start enforcement on May 2 unless the applicant submitted the ordinance update and related materials. The applicant submitted the PUD application in time to be heard by Zoning & Planning Commission; ZAPCO recommended the amendment with one exception. The applicant later withdrew the PUD amendment again before council action.
Council said the withdrawal ended the conditions that had paused enforcement; as of the council meeting the mayor announced his determination that the property remained in violation of the existing PUD ordinance and that deferred enforcement was no longer in place. No new enforcement step was announced on the dais that night; the council had previously authorized staff to proceed with enforcement if compliance was not met.
Why it matters: The Oaks at Lakeway PUD governs obligations tied to development and roadway construction. Withdrawal of the amendment does not erase the city’s finding of noncompliance under the existing ordinance; removing the deferral of enforcement could expose the property owner to enforcement steps if conditions are not remedied.
What’s next: The city attorney and staff previously advised the council and will follow the council’s direction on enforcement options; the applicant may pursue other remedial steps, reapply or seek to address the ordinance violation through the processes spelled out in city code.
