The Wylie Zone Board of Adjustments approved a variance on May 19 to allow an 8-foot fence at 1909 Fountain Spray Drive (ZBA 2025-08). The board voted unanimously, 4-0.
The variance was requested by Tina Brown to exceed a planned-development restriction that limits fence height to 7 feet. Planning staff told the board that the city’s zoning ordinance would allow an 8-foot fence by right, but the planned development documents for the Cascades subdivision cap fences at 7 feet. Kevin (planning staff) said, “the zoning ordinance does allow up to 8 feet, so it's not that they're asking for a variance on the city code, it's the planned developments code.”
The request included written approval from the Cascades Homeowners Association and public-notice mailing to 24 nearby properties; staff reported receiving one written approval and no objections. The applicant was not present at the hearing.
Board discussion was brief; a board member moved to approve “the variance as submitted by staff and is listed on the agenda,” a colleague seconded, and the motion passed unanimously.
Because the applicant sought relief only from the planned-development provision and not from the city zoning code itself, staff noted no additional conditions beyond standard permitting were required. No public commenters addressed this item during the hearing.
