Tavern report: underage sale checks, overserving incident under investigation; clerk and PD to send compliance reminders

The Public Health and Safety Committee reviewed the tavern activities report for April at its May 19 meeting and placed the report on file.

The police chief described joint compliance work with the health department that used underage decoys in plainclothes to test servers; three taverns sold to individuals under the legal limit of 21 during those checks. The chief emphasized that in those cases the patrons had identification listing their true date of birth and that the sales resulted from server error or failure to check dates of birth.

The chief also reported an incident at M and R bar in which an extremely intoxicated individual walked out, fell and suffered a traumatic brain injury. That incident is under investigation by the police department to determine whether there is any culpability or legal action related to overserving.

The report noted at least one noise complaint related to Aftershock and committee members discussed summertime concerns when open windows raise neighborhood sensitivity to sound. Committee members and staff discussed recurring compliance issues with operators failing to notify the clerk’s office of operational changes, including changes of location or outdoor operations, and occasional failures to post licenses or have the licensed bartender on duty carry their credential as required.

Staff and the clerk’s office agreed to draft a single communication—coordinating points from the police department and clerk—to send to all class B license holders ahead of the July 1 renewal cycle. The communication will remind licensees of upcoming compliance checks, noise expectations, license posting rules, and the need to inform the clerk’s office of operational changes.

The committee placed the tavern activities report on file with no recorded objections.
