Council orders inspection of deteriorating Main Street building after safety report

After a city official flagged a Main Street property with a detached window and a failing roof, staff were authorized to contact the owner and arrange interior and exterior inspections to determine whether to condemn or abate the structure.
A Main Street commercial building (parcel 5-9-3), adjacent to Milford Day Spa, was discussed at length on June 3 after the city received a report that a window had detached and the roof was failing. The building official recommended condemnation as a possible step; council members asked staff to seek owner cooperation and to arrange an interior inspection before making a final decision.
Staff said the property has shown progressive deterioration, with trucks causing the large windows to shake and portions of the roof collapsing after a recent big rainstorm. The owner, who staff believes also owns the Big Yellow Inn in Cedar City, had previously indicated plans years ago to demolish the structure for parking related to a proposed bed-and-breakfast; those plans never materialized.
Council members reviewed relevant codes. The building official identified the international property maintenance code and the city’s adopted ordinance language (listed as Chapter 3.03.0.01) as the municipal mechanisms to pursue condemnation and abatement. The council authorized staff and the building official (Kyle) to contact the property owner to gain permission for an interior inspection and to proceed with a formal inspection of the interior and exterior. Staff will report back with findings and recommended next steps.
Quote from the meeting: - “I think we need to, I mean, I hate seeing another condemned building on Main Street, but it's no good anyway. So why not let's clean it up and hope for the best,” a council member said.
Next steps: staff to contact the owner, arrange interior access with permission, involve the building official for inspection, and return to council with findings at a future meeting; the council asked staff to consult with the health department as needed.
