Racetrack lessee asks Montezuma County to permit assignment or short‑term change amid personal issues

Glenn, the lessee of the county racetrack, told the Board of County Commissioners he is dealing with personal issues and asked whether the racetrack lease can be assigned, amended or terminated.
County Attorney Steven briefed the Board on the contract’s structure and options. He said the existing agreement runs for three years at $15,000 per year and that the contract provides rights for assignment if the lessee obtains written permission. “Glenn also has certain rights under the contract… Glenn can get written permission to sign his part of the contract basically to someone else,” Steven said.
Glenn said he would explore either assigning the lease to another operator or, if necessary, seeking a one‑year modification this season so he could step away if his personal situation required it. A commissioner asked that any proposed assignee be presented to fairgrounds staff (Justin and Travis) for review, then returned to the Board for approval before an assignment is finalized.
County Attorney Steven said the Board has options ranging from amending or assigning the contract to enforcing its existing terms; he stressed that any legal advice to the Board would be privileged unless the Board chose to waive privilege. The Board asked staff and the lessee to meet with fairgrounds staff, prepare an agreement or assignment if appropriate, and place the item on a future agenda.
