County attorney reports Miller Parker case affirmed; board hears possible rehearing or appeal

The county attorney told the Harrison County Board of Supervisors that the Miller Parker case was affirmed by the circuit court. The attorney said the judgment included the sheriff as a party but that it was too late for the other side to add a party at this stage.
The attorney advised that the losing party may seek a rehearing or appeal to the U.S. Supreme Court, but said he was not sure whether that would occur. He added that although there have been recent developments in the law concerning qualified immunity, those changes probably would not change the outcome in this particular case.
A supervisor asked whether the affirmation included the state; the county attorney replied that it did. The attorney described the case as a “very unfortunate tragedy” and said the county was no longer making policy decisions in that litigation context.
