TJPA releases draft DBE participation level and SBE goal for public comment

The Transbay Joint Powers Authority presented its draft anticipated DBE participation level (ADPL) of 4.03% for federal fiscal years 2025'2028 and an accompanying small business enterprise (SBE) participation goal at the June 12 board meeting, and opened the draft for a 30-day public comment period.
Procurement and Contract Compliance Manager Anis Acevedo explained the two-step methodology required by 49 C.F.R. Part 26: (1) establish a base figure from DBE availability in the TJPA market area and (2) adjust the base figure using relevant evidence such as past TJPA DBE participation. For the ADPL staff expanded the set of NAICS codes and parsed anticipated contract scopes for the expected federally funded contracts (including heavy/civil construction and systems scopes) so the goal reflects the percentage of work by category and realistic market availability.
Acevedo said the draft ADPL was posted on the TJPA website on June 6 and the board's approval is scheduled after the 30-day public comment period; the final goal will be submitted to U.S. DOT by Aug. 1 if the board adopts it. The board asked questions about realistic, attainable goals and staff said the calculation weighed both market availability and TJPA's past DBE participation; several directors praised the more detailed, contract-weighted approach.
Why it matters: DBE and SBE goals shape outreach, bidding and contract-award strategies for large public works projects. TJPA staff said the revised approach aims to set achievable, enforceable goals appropriate to the work anticipated for portal procurements.
Next steps: The draft ADPL and SBE goal are open for 30 days of public review; staff will return to the board after the comment period to request adoption and will submit the final ADPL to the DOT by August 1, 2025.
