The Fort Smith Planning Commission approved a home-occupation permit on a vote of 8-0 to allow a physical therapy business by appointment only at 923 South 20 Fifth Street.
Planning staff told the commission the request, filed as Home Occupation 2625, is by “Miss Polk” to operate a physical therapy business subordinate to the single-family residence and in a duplex-medium-high-density zone. A neighborhood meeting held June 3 drew two neighboring property owners in support and staff reported one phone call in opposition. The applicant intends to operate Monday through Friday, 8 a.m. to 5 p.m., by appointment and use the existing driveway for client parking while parking a personal vehicle in the garage.
Staff recommended approval subject to Fort Smith parking regulations and a condition that the business license cannot be transferred to a different residence without a new home-occupation application. Commissioner Brett Taylor called the roll; the commission recorded eight votes in favor and no opposing votes. No members of the public spoke in opposition at the meeting.
Approval is final for the Planning Commission unless an interested party appeals to the City Board of Directors, which will review certain land-use matters at a future study session as described by staff.
