The Oro Valley Town Council on June 4 adopted Ordinance O25-03 to reclassify certain town-code violations — including some building and litter/garbage violations cited in cases commonly described as ‘‘junk houses’’ or hoarding situations — from criminal violations to civil violations for the first two offenses, reserving criminal enforcement for a third offense. Councilmember Jones Ivy seconded the motion; the ordinance passed 5-0.
Legal Services Director (presenting) said the town has seen an increase in complex hoarding or property conditions cases and that treating the first two enforcement actions as civil violations allows the town to seek cleanup and compliance without requiring a criminal record for residents. He said the courts, prosecutors and police supported the change and cited earlier statutory authority permitting such an approach.
The legal presentation noted previous code changes around notice requirements and said the new ordinance aligns penalties and procedures to provide an escalated civil enforcement mechanism with a criminal option for repeat noncompliance. The council adopted the ordinance after a short presentation and no recorded public opposition.
Staff will implement the new classification consistent with updated notice and enforcement procedures in the town code.
