Magistrate extends deadline for tenant build-out permits at Cooper Square; operator planning bagel restaurant

Special Magistrate Scott Klein amended a prior order for code violations at Cooper Square (9630 Sterling Road, Unit 106) and extended the compliance date to Aug. 5, 2025, to allow the new tenant time to apply for required building permits for a planned bagel restaurant.
Freddie Bolton, representing Cooper Square, said a lease was signed for the space and the new tenant intends to combine two bays to install a bagel restaurant. Carlos Vega, Community Development Director, told the magistrate that no tenant permits had been submitted as of the hearing and that the prior tenant’s unpermitted work must either be remediated or demolished to close the case. Klein said demolition permits could be accepted first to remove noncompliant work and encouraged the parties to meet with city staff to scope required demolition versus permitted build-out work.
Klein said if demolition or permit submittal occurs before the August hearing, the city will remove the matter from the docket; otherwise it will remain for review on Aug. 6. Klein said the extension is intended "not to penalize you for the acts of your prior tenant" while giving time for a lawful build-out.
The magistrate asked the city to coordinate with the property representative to explain what demo or permit steps are needed to resolve the violation.
