Sparks City Council voted unanimously on June 9 to adopt Bill 2832, amending the municipal zoning code to require conditional-use review for new drive‑through facilities and for intensification of existing drive-through operations.
Senior planner Danny Ray told council the existing code permitted new drive-through construction to be reviewed administratively but did not treat intensification of use in existing drive-through facilities (for example, a change from a low‑intensity financial institution drive‑through to a higher‑intensity coffee or fast‑food operation) as a discretionary entitlement that could be conditioned to mitigate impacts. Under the adopted amendment, a change that increases trips by 10% or more would trigger conditional-use permit review, including public notice and the opportunity for a planning‑commission hearing.
Ray said the proposed standards address stacking-lane design and length, visual screening, mitigation of light and noise impacts to adjacent residences, ordering‑equipment placement, pedestrian connectivity and safety, and the authority for the planning commission to revoke a CUP if queuing exceeds approved stacking lengths. He added that staff developed the standards in consultation with development‑community stakeholders and internal city departments to produce enforceable, implementable rules.
Council members praised staff for balancing development needs and community safety; no public speakers were recorded. The ordinance will be incorporated into municipal code Title 20 and staff will apply the new rules to future applications; existing drive-through operations that do not change operators or increase intensity are not affected by the change.
The motion to adopt Bill 2832 carried unanimously.
