Shelby County commissioners approved first reading of a proposed charter amendment that would allow the Board of Commissioners to appoint an independent legal advisor to advise the board on its legislative functions.
Sponsor Commissioner Erica Sugarman offered a substitute that clarified the proposed officeincluding language to simplify referendum wording for voters and provide translations if required. During debate Commissioner Edmond Ford sought to alter removal language; the body agreed to an amendment replacing a clause that would have permitted dismissal by the commission chair with language requiring dismissal '2by resolution,meaning the full commission would vote.
Supporters said the change would allow the legislative body direct access to legal counsel independent of the county attorneys office; critics raised fiscal and governance questions. County Attorneys Office staff said the office remains available and that attendance in meetings is discretionary; they confirmed the county attorneys office and the contracted special legislative counsel remain options for the commission.
The substitute passed first reading by roll call. The measure requires further readings and, if ultimately approved by the commission, a voter referendum because it amends the county charter. Commissioners noted a prior attempt in August 2024 failed by one vote and asked that the voting record be available at subsequent readings.
