Council rejects low bid as unresponsive, awards $10.99 million contract to Act 1 for Woodbury Park revitalization

The Garden Grove City Council rejected the lowest bidder for the Woodbury Park revitalization and expansion project as nonresponsive and approved a contract with Act 1 Construction in the amount of $10,992,000. Staff reported that six bids were opened; the apparent low bidder, Horizons Construction Company, was found to have multiple bid irregularities and staff concluded waiving those irregularities would give that bidder an unfair advantage. A protest from Act 1 Construction identified additional irregularities, staff said.
Act 1’s base bid totaled $10,393,088 with a bid alternate of $598,912 for LSI playground equipment for a combined project sum of $10,992,000. Staff verified licenses and references for Act 1 and recommended award. The project scope covers a full reconstruction across about 3.8 acres and includes a new 25-meter six-lane pool, two playgrounds (one LSI playground alternate), skate plaza, outdoor fitness equipment, basketball courts, restrooms, pool house, lighting, landscaping and a new parking lot.
Staff said the project is funded by Proposition 68 statewide park development and community revitalization grant funds and park fee funds; there is no impact to the general fund. If approved, work would begin in June 2025 with anticipated completion by March 2026. The council approved three recommendations: reject Horizons as nonresponsive, award the contract to Act 1 Construction for $10,992,000, and authorize the city manager to execute the agreement and make minor modifications. The vote was recorded as 7–0.
