The Lakeville Zoning Board of Appeals unanimously approved a special permit on May 15 to allow a 20-by-20 carport within setback measurements at 45 Howland Road.
Jeremy Burke, the petitioner, told the board the house has “a very short driveway” and limited on-site parking and said the proposed structure would replace an existing tent-like carport, noting his neighbor had provided a written approval included with the application. Burke said the new carport’s distance from the property line would be about 10 feet and the front setback about 20 feet from the street.
Board members read departmental memos into the record before voting. The Lakeville Board of Health reported no objections in a March 28 memo. Conservation staff said the proposed carport and house were “well beyond the 100-foot buffer zone” to nearby wetlands. The Planning Board reviewed the application on March 13 and reported no further comments or concerns.
A board member asked Burke to establish the property line with a formal survey before building, warning that if the carport were constructed closer than permitted, the board would not excuse the violation. Burke said he had an as-built plan in his submission and confirmed he would obtain a survey.
After a motion, a second and an oral vote the board approved the special permit. Staff said the applicant has two weeks to complete paperwork, the permit will be submitted to the county clerk, there is a 20-day appeal period, and after that the applicant may record the permit at the registry of deeds.
The board recorded the approval unanimously and closed the hearing.
