BOISE — Representative Jaren Crane, R‑Nampa, introduced RS 32,052 to the House State Affairs Committee and described edits he and his co‑sponsor made after meetings with trial lawyers and representatives of Idaho dairymen.
Crane said the amendments tighten enforcement language so that “law enforcement officers may enforce this section only when a person is detained or investigated for suspected commission of an independent crime under title 18, Idaho Code.” He told the committee the changes were intended to ensure the measure applies only where an actual crime is alleged and not to low-level infractions such as a turn‑signal violation.
Crane said he and his co‑sponsor agreed to most changes requested by stakeholders but declined a request to attach the bill to a Texas statute currently before the U.S. Supreme Court, saying Idaho should pursue its own approach.
Representative Barbieri said the tightened language addresses Fourth Amendment concerns and signaled support for introduction. The committee voted to introduce RS 32,052.
There was general agreement to explore the difference between crimes and infractions in a full hearing, and Crane said his co‑sponsor (a retired attorney) would give a deeper presentation at a later hearing.
