Developer and surveyor raise stormwater concerns for Sixth Street lots; commission to prioritize application in June

During public comment Doug Jones, a surveyor working with the owner/developer, requested commission guidance and asked that the Collins lots be placed at the top of the June agenda. Jones and staff discussed a long-standing stormwater-management pond that serves Oxford Court and related lots off Sixth Street and whether the pond remains functional or is the city’s responsibility.
Staff explained that the pond had been intended to serve Oxford Court but records show the parcel was sold and the pond currently belongs to the private owner (Mr. Collins) due to a parcel split error. Mr. Collins has indicated a willingness to offer to return the pond to the city, but staff recommended the owner perform an assessment to determine the pond’s condition and the extent of repairs needed before the city would accept it. Staff expressed concern the pond may be silted and overgrown and that future maintenance responsibility, liability and repair costs must be resolved.
Staff also noted that individual lots in the proposed subdivision are likely not exempt from stormwater-management requirements and will need to address stormwater on the lots as well as consider connections to the existing storm system. Jones asked that the Collins application be scheduled for the June meeting; planning staff agreed to prioritize the item on the June agenda and requested complete application materials so a staff report can be prepared.
No final decision was made; staff instructed the owner/developer to submit the necessary documentation and consultants’ assessments so that the commission can review the full application in June.
