The commission approved a zone change and concept plan for 3433 Hard Rock Road that would allow two long office‑warehouse buildings with truck docks facing Hard Rock Road and a higher parking maximum than the UDC typically allows.
Staff described the concept plan and said the applicant responded to prior council comments by increasing overall landscape area and providing live screening (evergreens and shrubs) along Hard Rock and SH‑161. Variances requested and recommended under prior approvals include reduced landscape buffer depths (from the usual 30 feet to as low as 15–20 feet at certain locations), permission for truck docks facing Hard Rock and an increased parking maximum to 161 spaces.
Applicant Jonathan Tooley, Hamilton Commercial, said the revised layout better serves civil constraints and that truck traffic will primarily access the site via the SH‑161 frontage; he noted a right‑of‑way dedication is anticipated to widen Hard Rock Road in the future. Commissioners asked about truck routing, right‑of‑way dedication and the need for drainage and noise studies; staff said those engineering items will be addressed during the civil/site‑plan review.
Commissioner John Federico moved to close public discussion and approve the project with DRC recommendations; Commissioner Ty Chapman seconded and the motion passed unanimously. Conditions include transportation department driveway approval, parking per Appendix X, line‑of‑sight and wing‑wall screening details, and engineering drainage/detention studies required prior to construction permits.
