Staff said a 2024 court ruling had found the property's zoning was single‑family; the applicant's request would reestablish a PD tailored to general retail and incorporate development standards from PD‑130. Staff notified 41 nearby property owners and received two letters of opposition (one unique address) raising concerns about traffic, accidents and preserving green space.
Jewel Choudhury, the developer, said the proposal has been in the works four years and currently supports two restaurants, a barbershop and a potential virtual golf facility; she said the project team had discussed the plan with neighborhood stakeholders. Commissioners asked about setbacks from backyards, lighting and hours; Choudhury said tenants would generally operate between about 10 a.m. and midnight.
Commissioner Cheryl Smith moved to approve the zoning change and concept plan per DRC recommendations; Commissioner John Federico seconded and the motion passed unanimously. Approval applies PD‑130 standards to the new development and requires transportation and engineering coordination during site‑plan review.
