The Montezuma County Board of County Commissioners continued a public hearing on May 27 for a proposed four‑lot moderate subdivision and related rezoning application submitted by Troy Jaskowski for property at 3261 Road H, Cortez.
Don Haley, county planning staff, described the proposal as a division of roughly 38–40 acres into four parcels, with a permitted planned‑unit development remaining on the west 20‑acre half and smaller parcels created at the northeast and southeast corners. Haley said access to one parcel would use a 60‑foot easement along the east property line. Surveyors later clarified the two smaller southeast parcels would each be about 3.2 acres after the easement was measured.
Commissioners and nearby residents raised concerns about the legal status and use of a private road and the dedicated 60‑foot access/utility easement that serves multiple parcels. “If that’s a specific concern the board wants more information about, I would make the recommendation that we continue this hearing so that I can look into the specifics of this road, and the specifics of the easement,” Haley said.
The board opened the hearing for public comment; no members of the public spoke. The board then moved to continue the hearing to allow staff time to research easement ownership, utility and public‑utility availability and any required road‑maintenance agreements. A motion to continue the hearing to June 10, 2025 at 9 a.m. was moved, seconded and carried by recorded ayes.
County staff said they will review public‑utilities availability and the legal conveyance and use of the easement before the continued hearing. The applicant and nearby property owners may be asked to provide documentation about the easement and historic use of the private road.
