Woods County adopts arena financing resolution, approves routine county business

Woods County commissioners on June 25 adopted a resolution authorizing the county to execute a security agreement tied to tax-increment revenues for the arena authority and moved several routine items forward, including approving minutes and directing staff to open and tabulate several bids.

County counsel explained that the arena project is being financed through a separate public trust created under Oklahoma law and that the county’s participation is limited to the security agreement by which certain tax-increment revenues would be pledged toward bond debt service. The attorney said the county itself would not directly own the real estate nor be a primary contracting party for project documents and that, based on the materials presented, the county’s exposure appeared limited. The commissioners then adopted a resolution authorizing execution of the security agreement and related documents.

Why it matters: The action clears a legal step needed for the arena authority’s financing to proceed by allowing county officials to sign the security agreement that routes increment revenues to the bond trustee. Commissioners were also careful to clarify that bondholders and the arena authority — not the county directly — would hold primary liability for the project’s indebtedness.
