Board declines fence-variance request; staff points applicants to neighbor-letter process

The Jonesboro Board of Adjustments declined a request to allow the interior-facing side of a replacement privacy fence at 2240 Williamsburg Drive to face inward toward the property rather than outward toward neighboring yards.
Josh Moss of Moss Fencing, representing the McIntosh property owners, told the board that at least two neighbors had called to say they were “perfectly fine with it” and that the homeowner would not expect neighbors to share the cost. Moss said the fence would replace an existing fence and that the owners wanted the continuity of the finished side facing the homeowners’ yard on three rear-facing sides.
Board discussion noted that, while some neighbors had expressed verbal support, the ordinance and the board’s practice favor receiving documented, certified letters from adjacent property owners. Monica (staff) pulled up the fencing ordinance for the board; the transcript records a recommendation that the applicant present certified neighbor letters to the planning office.
A motion to place the variance on the floor for a vote was called; the roll call recorded no votes in favor and the request was not approved. Staff told the applicant the variance has been approved in similar circumstances in the past but that the current record lacked certified neighbor consent required by the ordinance.
The applicant was directed to obtain neighbor letters and re-present the request to staff or the board if he wishes to pursue the variance again.
