Applicant withdraws Deep Woods rezoning; Embry Riddle representative records voluntary restrictions

The applicant for a rezoning listed as "Deep Woods" withdrew the item from the Lake County Board of County Commissioners' agenda on June 3, but the applicant's attorney read a statement into the record and committed to a set of voluntary, recorded restrictions intended to address community concerns.
Tara Tedrow, appearing on behalf of the applicant, said staff had advised that the conditional use permit (CUP) currently governing the property remained in effect and that the applicant had decided to proceed only under that existing CUP rather than seek rezoning. Tedrow told the board the applicant would record a private agreement that runs with the land and would limit future uses.
Tedrow read specific commitments into the record and said they would be recorded in public records upon closing. Those restrictions included that the property's only permitted uses would be "a paved single use private use airstrip" and "one new hangar not to exceed 10,000 square feet and 25 feet in height," and that "no flights would come to or from the property between sunset and sunrise." She also listed operational limits: only single-engine aircraft would be allowed, no leasing of the airstrip to unaffiliated third parties, no drone/UAV training on-site, hangar lighting to be dark-sky compliant, and the runway to be unlit for evening use. The applicant said they would obtain required approvals from the applicable Water Management Authority, Lake County Public Works and any other jurisdiction with permitting authority before making improvements that could affect wetlands or floodplains.
Mike Fitzgerald, Lake County planning and zoning director, confirmed the item was withdrawn and acknowledged the applicant's offer to record voluntary restrictions. Commissioners thanked the applicant for making the commitments and for offering them for the public record.
Because the rezoning item was formally withdrawn, the board did not consider or vote on the rezoning. Instead, the voluntary restrictions will be part of the public record and will "run with the land," the applicant said, intended to limit future owners to the uses described unless additional approvals are later sought and granted.
