The Newark Planning Commission on June 10 approved a two-year extension of a vesting tentative map for an eight-unit, for-sale condominium project at 36952 Mulberry Street, extending the map expiration date from June 22, 2025, to June 22, 2027.
Associate Planner Joseph Balotbat presented the request, saying the project consists of four two-unit dwellings created by merging two existing lots and that design review had been approved as part of the original entitlement. "The extension request of the vesting tentative map is being presented to the planning commission tonight due to financial constraints in the economy, which delay the commencement of the construction beyond the original anticipated schedule," Balotbat said. He told commissioners the design review approval would expire if not exercised or extended within two years, and the applicant sought the extension to allow more time to secure financing.
Deputy Director Artem Turiano explained the next steps and what constitutes vesting: "They have two years to pull a permit," he said. "Once you pull a permit, you have to pull a permit and start construction. ... And then that's what kind of vests your use, basically." The project team said they have been working with lenders and expect to move forward when financing is secured.
Property owner Tirmal Patelakrishnan (spelled in transcript) confirmed agreement with the resolution's conditions. Commissioner Aguilar moved to approve the two-year extension; Commissioner Fitz seconded. The motion passed 5-0. If implemented, the new expiration date will be June 22, 2027; design-review permits remain subject to director-level review and permit submittal timelines.
