Council approves UDOT betterment amendment, pays final waterline invoice and signs mixed‑use development agreement

At its June meeting, the Sunset City Council unanimously approved three items: Resolution 2025-12 amending a betterment agreement with the Utah Department of Transportation (UDOT); a final voucher for Alpine Excavating in the amount of $32,190.62 for the 1800 North Waterline Project; and a development agreement with applicant Matt Carter for a phased mixed‑use project on the Kirk property.
The council approved final payment for the 1800 North Waterline Project to Alpine Excavating, $32,190.62, after Public Works staff indicated the work was complete and functioning. Councilmember Bartley moved to approve the voucher; the motion was seconded and carried unanimously. Beau (city staff) told the council, “Yeah. It's done. It works. It's all hooked up, sanitary, so can't complain.”
The council then approved Resolution 2025-12, described in the meeting packet as amendments to a betterment agreement with UDOT. A council member moved to approve the resolution, there was a second, and the vote was unanimous.
Finally the council voted to approve a development agreement for a mixed‑use subdivision with Matt Carter. Carter told the council the project will be built in two phases: 46 lots in phase 1 and 38 lots in phase 2. He told the council the full development is expected to cost about $3.5 million with approximately $2.5 million for phase 1. Carter said the developer planned a pre‑construction meeting for June 10 to begin mobilization, and that horizontal site work for phase 1 should be finished before October. He said MC Green and Sons will perform the underground work and that building plans and permit applications are expected to be submitted in the coming weeks with vertical construction planned for September/October.
Council members raised a handful of clarifications before voting. One council member pointed out a typographical error in the draft agreement on page 6 where a setback was listed in words as "10 feet" but in parenthesis as "10 inches"; Carter and staff said they would correct that in the amendment. Public works and the council also asked that the developer include standard stormwater controls; Carter said a stormwater prevention plan and silt fencing will be implemented and SWPP signage put in place.
