At the start of the meeting the New York City Planning Commission voted to accept the minutes from its previous meeting by recorded roll call (John Johnson, Velez, Burgos and Gaines — ayes).
The commission also considered a set of relatively brief land‑development items and zoning cases. Key recorded votes and motions are listed below.
Votes at a glance
- 15 East Philadelphia Street (subdivision separating one lot into Lot 1 and Lot 2): The commission recommended approval of a land‑development waiver and a waiver to forego a preliminary subdivision plan. Commission discussion noted an earlier city interest in vacating an alley off Gas Avenue that staff later advised against; the applicant (Eric Peel, Peel and Company) said a quiet‑title action was being filed related to an alley overhang so Lot 1 could be configured without a cutout. Votes: recorded ayes by Johnson, Velez, Burgos and Gaines on the land‑development waiver and the preliminary subdivision waiver. A subsequent motion to recommend lot consolidation for an adjacent parcel (15 East Eleventh Street/CBDU district) also passed by roll call (ayes).
- 15 East Eleventh Street (lot consolidation): Motion to recommend approval of lot consolidation passed by recorded vote (Johnson, Velez, Burgos, Gaines — ayes).
- 300 East King Street (zoning variances): Attorney Summer Penitzo represented owners Young and Hye Ja Kwon. The application sought recognition of two units combined with an on‑site commercial use and relief from off‑street parking requirements after a zoning inspection found a previously uninspected third‑floor dwelling unit being rented. Staff had reviewed the filing and recommended approval for the variances noted in the agenda. The commission recommended approval of a variance to the off‑street parking requirements and a dimensional variance to allow an apartment combined with commercial use; roll calls recorded ayes by Johnson, Velez, Burgos and Gaines.
- 357 East Market Street (zoning variances and special exception): Owner Michael Miller told the commission the building was purchased and marketed to him as a two‑unit property. Staff recommended denial of several variances but recommended approval of the special‑exception pathway pending variance approvals. The commission voted to recommend approval of a set of variances (definition/dimensional/parkin) and to grant the special exception to allow the multifamily use; recorded roll calls show Johnson, Velez, Burgos and Gaines voting aye on those motions.
Minutes acceptance and the above motions were recorded by roll call. Where staff recommended denial for specific variances (notably in the 357 East Market record), the commission nevertheless voted to grant relief as described above. All of these commission recommendations will be transmitted to city council for final consideration.
The meeting also included other land‑development cases (127 North Broad, 319 Chestnut and 260 North Beaver) discussed and voted on in separate agenda items and covered in separate notices.
