The Middleton City Council approved a batch of land-use matters and an ordinance on June 4, clearing several subdivisions to proceed and adopting code changes that narrow when property owners may use an administrative lot split instead of a full subdivision process.
Final plats approved
- Mill at Middleton Subdivision (final plat): Council approved the 50-lot residential Mill at Middleton final plat and attached a condition that the developer may not receive the first building permit until the historic Middleton Mill sign is repaired or replaced to its original condition. Planning staff had recommended approval and the council added the condition after neighbors and council members raised concerns about a damaged historic sign. Council vote: motion moved, seconded and approved by voice vote (aye); no roll-call tally provided.
- River Pointe Subdivision, Phases 1–3 (final plats): Council approved final plats for River Pointe Subdivision Phases 1 (28 patio homes), 2 (30 townhome lots) and 3 (7 commercial lots). Planning staff reported that infrastructure is complete, development fees were paid and the city engineer recommended approval. Council votes: motions moved, seconded and approved by voice vote (aye) for each phase.
Preliminary plat and waivers approved
- Middleton Commons Condominium preliminary plat (re-subdivision of Middleton Industrial Park No. 2): Planning staff recommended, and the council approved, the preliminary condominium plat that would create 44 industrial/commercial condominium units and seven common lots. The applicant requested and the council granted waivers to allow 0-foot lot lines and higher lot coverage necessary for a condominium layout in the M-1 zone. Conditions of approval include recording an operations and maintenance plan for stormwater facilities with the business association and completion of planning/engineering/fire/public works comments before final plat.
Administrative lot-split ordinance adopted
- Ordinance 708 (MCC 5-4-9 amendments): The council adopted Ordinance 708, which restores an "original date" (August 10, 1976) to the administrative lot-split code and tightens standards for administrative lot line adjustments, one-time splits and consolidations. Planning staff said the amendments clarify when a property owner may use the administrative process versus the subdivision process (for example, administrative adjustments cannot be used to create landlocked parcels, change zoning boundaries, or require construction of new roads or easements). The council adopted the ordinance on a voice vote.
Other actions
- Consent agenda: payroll, warrants and administrative matters were approved by voice vote.
Why it matters: the plats clear several new residential and commercial developments to proceed, subject to conditions. The administrative-lot-split ordinance changes are intended to prevent informal or "illegal" splits that create landlocked parcels or otherwise evade subdivision requirements.
Ending: Staff will follow up to make sure conditions (historic sign repair, utility upgrades and recorded stormwater O&M covenants) are satisfied before final plats are filed and building permits issued.
