County planning director: retail marijuana sales are prohibited in Mayville; rezoning is an option

Eric Bissonnette asked the Gilliam County Court on May 7 to permit retail marijuana sales in Mayville. The county’s acting planning director said the Gilliam County land‑use code prohibits retail marijuana outlets in the RC (rural unincorporated community) zone that applies to Mayville.
Carla McClain explained that Gilliam County's Zoning and Development Code (section 8.27 and the zoning/use table on page 8‑47) distinguishes production, processing and retailing and assigns where each use is allowed (administrative approval, conditional use permit, or prohibited). She said production and processing can be approved in Mayville through conditional use permits, but retail sales are prohibited in the Mayville designation and are permitted only in limited or general industrial zones.
McClain described the county’s options: a landowner can apply for a change to the zoning map (a rezoning), or the county can initiate a rezoning process; either path requires a public hearings process before the planning commission and county court and may or may not be approved. Bissonnette said he will contact planning staff to pursue a rezoning application and the planning department said staff will provide guidance on the formal application requirements.
No immediate zoning change was made; the planning department will meet with Mr. Bissonnette to explain the rezoning application process if he chooses to pursue that option.
