Planning Commission votes: zone changes, plats, daycare permit, deferrals and site approvals sent to council

The City of Toledo Planning Commission handled a series of zoning, plat and permit items during the meeting, approving final plats, rezoning requests and special permits and deferring two commission-originated studies to the July 3 agenda. Items recommended to City Council are scheduled for July 16.

Key votes and outcomes

- Final plats: The commission approved two final plats: S250004, the subdivision for the Toledo-Lucas County Public Library Washington Branch (3124 Tremainesville Road), and S250005, a 0.303-acre subdivision at 815 Of Our Avenue. Staff recommended approval of both final plats and commissioners voted to approve both unanimously.

- Z250013 (539 Broadway): The commission approved a zone change from Neighborhood Commercial (CN) to Mixed Commercial/Residential (CM) at 539 Broadway, enabling ground-floor residential units in a building where the last use had been a daycare and earlier a funeral home. The applicant, represented by Brian Watkins and architect Scott Rossi, said the proposal would create accessible and additional units; no members of the public spoke in opposition. The commission approved the change and forwarded the recommendation to City Council (scheduled July 16).

- C250014 (4256 Seacor Road): The commission approved a zone change to consolidate an irregular lot into regional commercial to accommodate an indoor dog water park business (Cannonballs LLC). Staff recommended approval and the applicant indicated plans for a dog run on the formerly residentially zoned portion of the lot. The commission approved the request and will forward it to City Council on July 16.

- Z250011 (1513/1517 South Reynolds): OUT Plumbing & Heating requested rezoning of two parcels from RS-12/CO to CR to formalize an existing plumbing operation and allow indoor storage and fleet parking. The commission approved the request despite staff noting it would allow broader CR uses in the future; the commission said site-plan review would require screening and buffering for the adjacent residential area. The application will be presented to City Council on July 16.

- SUP250013 (2225 Dorr Street): The commission approved a special-permit upgrade from a type-B family daycare (up to six children) to a type-A facility (up to 12 children) at 2225 Dorr Street with conditions requiring submission of fencing, lighting and landscape plans and compliance with the required outdoor play area and buffers. The vote was 3-1 in favor; a recorded nay was entered by Commissioner Ball. The applicant said she has permission from a neighboring property owner to use a vacant lot across the street for parent parking; the planning staff noted final landscaping and play-area sizing must be verified before licensing.

- Deferrals: Two planning-commission-initiated cases were deferred to the July 3 agenda: a modification to Toledo Municipal Code (TMC) Chapter 11 to eliminate parking minimums (case M1824) and a study of scrap and salvage facilities (case M325). Staff deferred both to allow more time for review after late staff reports.

- SPR3054 (3054 Monroe Street): The major site-plan review for 3054 Monroe Street was presented but two commissioners recused themselves, leaving the commission without a quorum to act. Staff took testimony; the applicant was told the case would be rescheduled to the July 3 agenda. Staff noted there were 35 conditions and four waiver requests included in the staff report.

All items being forwarded to City Council are scheduled for review on July 16 as part of the commission's referral process.
