DeKalb County commissioners on June 3 agreed to re-file a previously approved superior-court appropriation resolution after county clerks discovered the resolution itself was not recorded in Legistar or the committee record.
Commissioner Nicole Messiah explained she was walking on an amendment to agenda item 2025-0523 so that the "original resolution as considered and approved by the board of commissioners" would be added into Legistar. Clerks and legal staff said the resolution was absent from the committee record that becomes the official file, which prevents a clear public record of what had been approved.
DeKalb County legal counsel and clerks described the problem at the meeting. "I'm sorry. Legistar is not the issue. It was not walked on during the proper meeting, the proper body," the clerk said, explaining the missing step. County legal staff said the resolution "was never properly substituted and never made it into the record," a procedural omission that requires amending the previously adopted item so the resolution appears in the official record.
Commissioners discussed how to remedy the omission. Central staff and clerks recommended an amendment to the previously adopted item as the quickest corrective measure; the amendment was to be routed through the Finance, Audit and Budget (FAB) committee before returning to the board for formal recording. Commissioners and staff also noted a timing risk: if the item is refiled and later vetoed by the CEO, there may be no opportunity to correct the record before the end of the month. Legal staff said there was no current indication of an intended veto but cautioned about the tight calendar.
The board instructed staff to place the amended resolution into FAB so committee and full-board records would reflect the measure with the resolution attached. Commissioners emphasized they wanted a permanent, searchable record in Legistar and the official minutes.
Ending: Central staff said the amended agenda item will be heard in FAB the next committee cycle and that routing would allow a full‑board vote before the end of June; commissioners asked clerks to confirm the corrected item in Legistar and the official minutes.
