The Town of Lakeville Parks Commission voted to allow Schools Out Ice Cream to drive its ice cream truck through town parks as part of a routine route, with conditions including a suggested end-of-season donation and a 5% event donation for the first year.
Commissioners said they wanted a simple process for the vendor and protections for existing park concessions. Mr. Gallagher, the operator of Schools Out Ice Cream, told the commission, “We actually just started ice cream. We took an old school bus and changed it into an ice cream truck and we actually have 3 routes planned around Lakeville and we're actually hoping to get permission to drive through Ted Williams on the beginning of our routes and at the end because we live about 5 minutes from here so it would be a good start and ending point for us.”
The commission discussed concerns about competing with existing snack shacks; a commissioner noted John Pond Park’s snack shack and said they did not want to “take away from what they already had.” The commission also asked the vendor to provide a binder or proof of insurance and confirmation of health-board clearance before operations in parks.
A parks commissioner moved to allow the truck to drive through parks as part of its routine route, with a suggested donation of the vendor’s choice at the end of the summer season; if the truck parks at an event such as a tournament or tryfest, the vendor will pay a standard 5% donation of proceeds for the first year. Another commissioner seconded the motion. The commission approved the motion; the transcript records the motion as carried and the chair instructed staff to send a formal email to the vendor outlining documentation needed.
Commissioners asked that the vendor receive a short formal notice he could show while driving through parks, and discussed signage noting the vendor was “approved” or “sponsored/approved by” the parks commission. They also agreed to re-evaluate the donation rate after the first year.
