The Madison County Planning and Zoning Commission heard and acted on multiple land-use items at its Sept. 15 public hearing. The commission's role is advisory; the Board of Commissioners will hold the final public hearings on Oct. 6. Below are the actions the commission voted to recommend to the county commission.
Votes at a glance
- Vertical Bridge / T-Mobile — conditional use to allow a 265-foot telecommunications tower at 8397 Highway 172 (Map 93, Parcel 046). Commission action: recommend approval to the Board of Commissioners. The applicant presented coverage maps and photo simulations; no members of the public spoke in opposition during the hearing.
- Dan Loring — rezone 5 acres from A1 to AR to allow conversion of a barn to an accessory dwelling unit for family. Commission action: recommend approval to the Board of Commissioners.
- Matthew DePalma / Triple H Sanitation — conditional-use permit for a transfer station on 0 Business Drive (approx. 5 acres). Commission action: recommend approval 3–1 to the Board of Commissioners (see separate article for discussion and public comment).
- Bobby (Byron) Patrick / Ryan Patrick — rezone 16.79 acres from A1 to AR to split into family tracts (two 4-acre tracts and one 8.79-acre tract). Commission action: recommend approval.
- Byron Beam — rezone 5.97 acres from A1 to AR to allow an accessory dwelling unit for parents at 1125 Shoal Creek Road. Commission action: recommend approval.
- Kim Wood / Larry & Melissa Little — split and rezoning to allow a 4-acre lot to be gifted and remainder to be rezoned to bring property into zoning compliance at 1461 Fifth Davis Road. Commission action: recommend approval.
- Raw River Mining LLC (Berkeley quarry) — conditional use to reopen an existing quarry for aggregate mining on a 278.62-acre site. Commission action: recommend approval with conditions (require CSX rail spur approval and installation; limit most surface operations to 6 a.m.–6 p.m. Monday–Saturday, but allow rail loading/transport outside those hours). - Items 8 and 9 — withdrawn (no action taken).
- Items 10–12 (George Smith & Peggy Lee applications) — a set of related rezoning and lot-split requests covering portions of Rogers Mill Road and Dalton Smith Road (multiple tract reorganizations totaling roughly 48.86 acres when combined). Commission action: recommend approval; neighbors raised a safety concern about a proposed 50-foot access easement and urged placement of driveway access away from a dangerous curve.
- Zoning text condition change (Interstate 85 purposes / industrial parcel at 11270 Highway 98 West) — application to revise conditions placed on a 6.09-acre industrial parcel so that the property continue to be limited to industrial uses but to allow storage of compressed gases regulated by OSHA while prohibiting manufacturing or storage of hazardous materials; commission action: recommend approval.
