Applicant withdraws Pope's Lane shipping-container permit application; board allows refile within month

The Danvers Zoning Board of Appeals on July 28 accepted a request to withdraw, without prejudice, an application to allow two storage containers at 20 Pope's Lane.
Attorney Nancy McCann, representing EDM Construction, told the board the original filing “does not correctly describe what the applicant is looking for” and needs to be re-advertised. McCann said she expects to refile “within a month.”
Board members discussed the case's history. Corinne Doherty, outgoing chair, said she believed the board’s March direction to the applicant had been “real clear” and expressed concern about the matter remaining open-ended. Doherty said she believed the property may be in violation of conditions on the site.
After the applicant requested withdrawal without prejudice, a member moved to allow the withdrawal and the board voted in favor. The board did not adopt new conditions or set a formal refiling deadline beyond the applicant’s statement she expects to refile within a month.
Because the applicant withdrew without prejudice, no permit or change in use was approved. The board record shows a formal motion to allow withdrawal was made, seconded and approved by voice vote.
